Welcome to Ask Ivy! These Terms of Service ("Terms") govern your use of the Ask Ivy platform and services. Please read them carefully.
Quick Summary: Ask Ivy helps you find colleges that fit your profile and preferences. You're responsible for providing accurate information. We provide guidance and recommendations, but we don't guarantee college admissions. You must be at least 13 years old to use our service.
1. Acceptance of Terms
By creating an account, accessing, or using Ask Ivy, you agree to be bound by these Terms and our Privacy Policy. If you don't agree to these Terms, please don't use our service.
If you are under 18 years old, you represent that you have reviewed these Terms with a parent or legal guardian, and they consent to your use of Ask Ivy.
2. Eligibility
You must meet the following requirements to use Ask Ivy:
- Be at least 13 years old
- Provide accurate and complete information when creating your account
- Not be prohibited from using our service under applicable law
- Comply with all local, state, national, and international laws and regulations
Important: If you are under 13, you are not permitted to use Ask Ivy. If we discover that a user is under 13, we will terminate the account and delete all associated information.
3. Description of Service
Ask Ivy is a college admissions guidance platform that:
- Provides personalized college recommendations based on your academic profile and preferences
- Calculates estimated admission likelihood for colleges (your chances of acceptance)
- Calculates fit scores for colleges (how well they match your preferences)
- Computes your Ask Ivy Score (a measure of your well-roundedness and college readiness)
- Helps you track your college application progress
- Offers an AI-powered assistant to answer your college-related questions
- Provides information about colleges, majors, and the admissions process
Ask Ivy is a guidance tool, not an admissions guarantee. Our recommendations, likelihood estimates, fit scores, and Ask Ivy Scores are based on available data and should be used as one of many resources in your college search process.
4. User Accounts and Responsibilities
4.1 Account Creation
To use Ask Ivy, you must create an account by providing:
- A valid email address
- Your name
- A secure password
You may also sign up using your Google account.
4.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
4.3 Accurate Information
You agree to:
- Provide true, accurate, current, and complete information
- Update your information to keep it accurate and current
- Not impersonate any person or entity
- Not create multiple accounts or share your account with others
Why accuracy matters: Our recommendations are only as good as the information you provide. Inaccurate information may result in inappropriate college recommendations.
5. Acceptable Use
5.1 Permitted Uses
You may use Ask Ivy to:
- Research colleges and admissions requirements
- Receive personalized college recommendations
- Track your college application progress
- Seek guidance on the college admissions process
5.2 Prohibited Uses
You may NOT:
- Use Ask Ivy for any illegal purpose
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the service or servers
- Use automated scripts, bots, or scrapers to access the service
- Reverse engineer, decompile, or disassemble any part of Ask Ivy
- Copy, modify, or distribute our content without permission
- Harass, abuse, or harm other users
- Upload viruses, malware, or malicious code
- Use the service to spam or send unsolicited messages
- Sell, resell, or commercially exploit the service
6. Intellectual Property
6.1 Our Content
All content on Ask Ivy, including but not limited to:
- Text, graphics, logos, and images
- Software and code
- College data and recommendations algorithms
- Design, layout, and user interface
...is owned by Ask Ivy or our licensors and is protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain ownership of the information you provide to Ask Ivy (your profile, academic data, etc.). By using our service, you grant us a license to:
- Use your information to provide and improve our services
- Create aggregated, anonymized data for analytics and research
- Display your information back to you within the platform
This license ends when you delete your account, except for anonymized data that cannot be traced back to you.
7. Disclaimers and Limitations
7.1 No Admissions Guarantee
IMPORTANT: Ask Ivy provides guidance and recommendations only. We do not and cannot guarantee:
- Admission to any college or university
- Scholarship or financial aid awards
- The accuracy of third-party college data
- Specific outcomes from using our service
College admissions decisions are made solely by colleges and universities, not by Ask Ivy.
7.2 Service "As Is"
Ask Ivy is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the service will be uninterrupted, secure, or error-free
- Warranties regarding the accuracy or reliability of information
7.3 Third-Party Content
Ask Ivy displays information about colleges and universities obtained from public sources and third parties. We strive for accuracy but cannot guarantee that all information is current, complete, or error-free. Always verify important information directly with colleges.
7.4 AI Assistant Limitations
Our AI-powered assistant provides general guidance and information. It:
- May make mistakes or provide incomplete information
- Should not be considered professional admissions counseling
- Is not a substitute for speaking with college admissions offices or professional counselors
8. Limitation of Liability
To the fullest extent permitted by law:
Ask Ivy, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or data
- Loss of college admissions opportunities
- Costs of substitute services
- Damage to reputation
- Any other intangible losses
This limitation applies regardless of whether Ask Ivy was advised of the possibility of such damages.
In no event shall Ask Ivy's total liability to you for all claims exceed the amount you paid to Ask Ivy in the 12 months prior to the claim (or $100 if you haven't paid anything).
9. Indemnification
You agree to indemnify, defend, and hold harmless Ask Ivy and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Any false or misleading information you provide
10. Termination
10.1 Termination by You
You may terminate your account at any time by:
- Visiting your Settings page and selecting "Delete Account"
- Your account will be deactivated immediately
- You have 30 days to recover your account if you change your mind
- After 30 days, your data will be permanently deleted
10.2 Termination by Ask Ivy
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Any other reason at our sole discretion
10.3 Effect of Termination
Upon termination:
- Your right to use Ask Ivy immediately ceases
- Your data will be handled according to our Privacy Policy
- Sections of these Terms that should reasonably survive (like liability limitations and indemnification) will continue to apply
11. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. The Privacy Policy is incorporated into these Terms by reference.
12. Changes to Terms
We may modify these Terms at any time. When we do:
- We will update the "Effective Date" at the top
- For material changes, we will notify you via email or a prominent notice in the app
- Your continued use of Ask Ivy after changes take effect means you accept the new Terms
- If you don't agree to the new Terms, you must stop using Ask Ivy and may delete your account
13. Dispute Resolution
13.1 Informal Resolution
If you have a dispute with Ask Ivy, please contact us first at [email protected]. We'll work with you to resolve the issue informally.
13.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], United States, without regard to its conflict of law provisions.
13.3 Arbitration
Any dispute arising from these Terms or your use of Ask Ivy shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property or data security issues.
Arbitration will be conducted by a neutral arbitrator in accordance with the American Arbitration Association's rules. The arbitrator's decision will be final and binding.
Class Action Waiver: You agree to resolve disputes with Ask Ivy on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative proceedings.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ask Ivy regarding the use of our service.
14.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign our rights and obligations without restriction.
14.5 Third-Party Beneficiaries
There are no third-party beneficiaries to these Terms.
14.6 Force Majeure
Ask Ivy shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, natural disasters, or internet service failures.
15. Educational Guidance Disclaimer
Ask Ivy is designed to provide general information and guidance about the college admissions process. Our service:
- Is not a substitute for professional college counseling or admissions consulting
- Does not provide legal, financial, or professional advice
- Should be used as one of many resources in your college search
- May not account for all factors that colleges consider in admissions decisions
We encourage you to:
- Consult with your school's guidance counselor
- Visit college campuses and speak with admissions offices
- Research multiple sources of information
- Make decisions based on your own judgment and circumstances
